Please read these Terms and Conditions ("Terms") carefully before using the Furbabies mobile application ("the App") operated by Furbabies ("we", "us", or "our").
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
2. Description of Service
Furbabies is a pet age calculator application that converts pet ages to human years using scientifically-based formulas. The App provides:
- Age calculations for multiple pet species
- Pet profile management with photo storage
- Home screen and lock screen widgets
- Birthday and milestone notifications
- iCloud synchronization (premium feature)
3. User Accounts and Data
The App stores data locally on your device and optionally in your iCloud account. You are responsible for maintaining the security of your device and iCloud account. We are not responsible for any loss of data due to device failure, loss, or unauthorized access to your accounts.
4. Free and Premium Features
The App offers both free and premium features:
- Free Features: Up to 2 pet profiles, basic widgets, birthday reminders
- Premium Features: Unlimited pet profiles, all widget types, photo timeline, iCloud sync, share cards
Premium features require a one-time in-app purchase. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions.
5. In-App Purchases
Premium features are available through a one-time in-app purchase. By making a purchase, you agree to:
- Pay the listed price for the premium upgrade
- Apple's App Store terms of service and refund policies
Refunds are handled by Apple according to their refund policy. Please contact Apple Support for refund requests.
6. Accuracy of Information
While we strive to provide accurate age calculations based on scientific research, the results are estimates and should not be used as a substitute for professional veterinary advice. The age calculations are for informational and entertainment purposes only.
7. Intellectual Property
The App, including its design, features, code, and content, is owned by Furbabies and is protected by copyright and other intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use the App for any commercial purpose without permission
- Remove any copyright or proprietary notices
8. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Upload malicious content or attempt to compromise other users' data
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURBABIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by updating this page. Your continued use of the App after changes constitutes acceptance of the new Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
